Work Experience :
Roy has first-chaired numerous patent and trademark litigations in district courts around the United States, and has briefed and/or argued dozens of appeals at the U.S. Court of Appeals for the Federal Circuit and other appellate courts. His successes in patent litigation include an appellate victory against Johns Hopkins University in a case involving fragmentation catheters, and an appellate victory invalidating, for lack of patent-eligible subject matter, 242 claims across four patents asserted against Diebold, Inc.’s ATMs. He also played a major role in cases before the federal courts and the Patent and Trademark Office vindicating the patent rights of laser pioneer Gordon Gould.
Roy’s successes in trademark and trade dress litigation include a decision invalidating the trademark AMERICA’S MOST CONVENIENT BANK claimed by Commerce Bank (now TD Bank); a preliminary injunction enforcing the unregistered trademark TRANSFER PRINT; and the first successful enforcement of Ralph Lauren’s trademark POLO.
Roy also represented New York University in a royalty dispute against Pfizer, Inc., successfully briefing an appeal and summary judgment motions resulting in a favorable settlement.
Roy has served as an expert witness and a mediator in both patent and trademark cases. He has authored four law review articles and dozens of practice articles. He has taught Patent Litigation at Rutgers Law School.
Roy served as an equity partner with Lerner David Littenberg Krumholz & Mentlik LLP for over three decades before joining Kaplan Breyer Schwarz LLP.
